What is Edible Food?

Edible food means food that is intended for people to eat, including food not sold because of appearance, age, freshness, grade, surplus, etc. Edible food includes prepared foods, packaged foods, and produce. All food donations must be in compliance with the California Retail Food Code. 

SB 1383: Commercial Edible Food Generators

California state law SB 1383 and Monrovia Municipal Code 8.46.060 require "Tier I" and "Tier II" Commercial Edible Food Generators to donate the maximum amount of excess edible food to feed people.

  • Supermarkets with revenue ≥ $2 million
  • Grocery Stores with Facilities ≥ 10,000 sq. ft.
  • Food Service Providers
  • Food Distributors
  • Wholesale Food Vendors
  •  Restaurants with Facilities ≥ 5,000 sq. ft. or 250+ seats
  • Hotels with an On-Site Food Facility and 200+ Rooms
  • Health Facilities with an On-Site Food Facility and 100+ Beds
  • Large Venues and Evens
  • State Agency Cafeterias with Facilities ≥ 5,000 sq. ft. or 250+ seats
  • Local Education Agency with an On-Site Food Facility
  • Non-Local Entities

 

Commercial edible food generators are counted on to:

  • Recover the maximum amount of edible food that would otherwise be disposed
  • Maintain records of edible food recovered, specifically:
    • Keep record of the name, address and contact information of the service or organization that collects its edible food for donation
    • Keep record of the type of food that will be collected or self-hauled/back-hauled
    • Keep record of the established frequency that food will be collected or self-hauled/back-hauled
    • Keep record of the amount of food donated (in pounds)
  • Establish a written contract or agreement with a food recovery organization or service for collection of surplus food

Food Recovery Organizations

The City of Monrovia is participating in the FRESH SGV program, a collaboration with the San Gabriel Valley Council of Governments (SGVCOG). Together, we've partnered with three local nonprofits to launch regional food recovery hubs. Hubs collect surplus food from grocery stores and restaurants and redistribute it to smaller food banks, food pantries, or directly to the community to reduce food waste and food insecurity in our community. Monrovia's subregional food recovery hub is Foothill Unity Center.
